Chapter 13 discharge shrinks
The Chapter 13 discharge under the new law looks awfully like the Chapter 7 discharge. Chapter 13 will still discharge 1) non support debts incurred in the course of a divorce , 2) debts for willful damage to property, and 3) fines and penalties, debts not dischargeable in Chapter 7.
Stricken from the discharge by the 05 amendments are the discharge of debts tinged with fraud, tax claims for which no claims were filed, or old tax years for which no returns were filed.
